LocateX Terms of Service

By downloading or using the app, these terms will automatically apply to you, you should make sure therefore that you read them carefully before using the app. You're not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to LocateX.

LocateX is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you're paying for.

The LocateX app stores and processes personal data that you have provided to us, in order to provide our Service. It's your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the LocateX app won't work properly or at all.

You should be aware that there are certain things that LocateX will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but LocateX cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don't have any of your data allowance left.

If you're using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, LocateX cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can't turn it on to avail the Service, LocateX cannot accept responsibility.

With respect to LocateX responsibility for your use of the app, when you’re using the app, it's important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. LocateX accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

IN-APP PURCHASE AND PAYMENT

The release and distribution of the LocateX Apps will take place in the global market through the Apple App Store, The User's purchase and payment processes may vary depending on the platform used. Please make sure that you carefully read the rules set by the relevant platform regarding purchase and payment transactions. The LocateX Apps will nevertheless offer certain features and certain limits to the User as a paid feature through in-app purchase. If the User would like to use such paid features under this Agreement, you will first need to make payment before accessing the paid feature.

Such in-app purchase features are offered on an annual, semi-annual, quarterly, monthly or a weekly basis and will be re-billed every year or month by the Apple App Store , depending upon auto-renewable subscription model, until cancelled by the User. The Apple App Store will send an e-mail well in advance of renewal containing a hyperlink to manage subscription procedure. App payments will be processed through the Apple App Store and from which you originally downloaded the application. You may access the applicable in-app purchase rules and policies directly from the Apple App Store and. You acknowledge and agree that you are fully responsible for managing your in-app purchases and the amount you spend on in-app purchases within the LocateX Apps.

If you are under 18 then you are legally required to have you parents’ or legal guardians’ permission to make any in-app purchases. By completing an in-app purchase, you are confirming to us that you have any and all permission that may be necessary in order to allow you make that in-app purchase. If you are a parent or legal guardian of someone under the age of 18, we recommend that you consider any parental control that may be provided by the Apple App Store and, provided that you are concerned that your child may make excessive in-app purchases.

The in-app purchases are purchased from and billed by the Apple App Store, not LocateX. These purchases are subject to the terms and conditions of the Apple App Store. All billing and refund inquiries shall be directed to the Apple App Store and. Having said that, LocateX does not have access to the Apple App Store and accounts and transactions.

You acknowledge and agree that all billing and transaction process are handled by the Apple App Store and from whose platform you downloaded the LocateX Apps and governed by the Apple App Store and’s terms and conditions/end user license agreement. If you have any payment related issues with in-app purchases, then you need to contact the Apple App Store directly.

Changes to These Terms of Use

We may update our Terms of Use from time to time. Thus, you are advised to review this page periodically for any changes. we will notify you of any changes by posting the new Terms of Use on this page.

These terms of use are effective as January 2025.
